Terms of Service

These Terms of Service ("Terms") govern your use of the seenby.my website and general interactions with SeenBy, operated by P&I Digital Solution (Registration No. 202603129117 / NS0322940-V), a service provider based in Selangor, Malaysia ("SeenBy," "we," "us").

By using seenby.my or engaging with SeenBy, you agree to these Terms. If you become a paying client, the Service Agreement you sign governs your paid engagement and takes precedence over these Terms for anything specific to that engagement.

1. What SeenBy Is

SeenBy is an AI visibility monitoring and reporting service. We track how often, and how, AI platforms (currently ChatGPT, Perplexity, Gemini, and Claude) mention a business when asked relevant questions, and report on that visibility along with recommendations to improve it.

SeenBy operates on a managed-service, agency model. We do not offer client self-service logins or a public dashboard — access to results is via a private link we issue, or reports we send directly.

2. Free Scans and Prospect Interactions

We may run a complimentary, limited-scope scan on a business as part of a sales conversation, before any agreement is signed. This is provided at our discretion, may use a limited subset of platforms and query types compared to our paid service, and does not create any ongoing obligation on our part unless a Service Agreement is subsequently signed.

3. No Guarantee of AI Platform Behaviour

This is important: SeenBy does not control, own, or operate ChatGPT, Perplexity, Gemini, Claude, or any other AI platform. We report on what these third-party systems say at a given point in time. Their outputs can change due to factors entirely outside our control, including:

  • Changes to the platform's underlying model or training data
  • Changes to the platform's own policies or ranking/retrieval logic
  • Natural variability in AI-generated responses (the same query can produce different answers on different occasions)

We do not guarantee specific visibility scores, rankings, citation frequency, or any business outcome. Any score improvements, case studies, or examples referenced on our website or in our materials are illustrative of past results for specific clients and are not a promise of similar results for any other business.

4. Acceptable Use

You agree not to:

  • Use seenby.my or any SeenBy output to harass, defame, or misrepresent any business, including competitors
  • Attempt to access another client's or prospect's data or private client-view link
  • Reverse-engineer, scrape, or misuse SeenBy's scanning methodology or scoring system
  • Use SeenBy's name or materials to imply an endorsement or partnership that doesn't exist

5. Intellectual Property

The SeenBy name, scanning methodology, scoring system, report design, and all underlying software remain the exclusive property of SeenBy. Nothing in these Terms grants you any licence to that IP beyond what's explicitly provided in a signed Service Agreement (e.g. a client's licence to use their own delivered reports for internal/marketing use).

6. Third-Party Content and Accuracy

Where SeenBy references AI-generated content (including "hallucinations" — instances where an AI platform states something inaccurate about a business), we report this as observed. We are not responsible for the accuracy of any third-party AI platform's output, and flagging an inaccuracy to a client does not constitute a guarantee that it will be corrected by the platform in question, as this is outside our control.

7. Limitation of Liability

To the maximum extent permitted by Malaysian law, SeenBy's total liability arising from your use of seenby.my or any free/prospect interaction (i.e., outside of a signed Service Agreement, which has its own liability terms) shall not exceed RM 500. SeenBy shall not be liable for indirect, consequential, or loss-of-profit damages arising from use of this website or any complimentary scan.

8. Changes to These Terms

We may update these Terms from time to time, with the "Last updated" date above reflecting the most recent revision. Continued use of seenby.my after changes take effect constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes will first be attempted to be resolved amicably, and failing that, referred to the courts of Malaysia.
